These Terms of Service ("Terms") govern your use of the PULSE Sports Management platform ("Service") operated by PULSE Sports Management Ltd ("PULSE", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must be at least 18 years old to create an organisation account. Individual member accounts for under-18s must be created by a parent or guardian.
You agree to use the Service only for lawful purposes related to the management of sports clubs, teams, and related activities. You must not use the Service to store or transmit malicious code, infringe the intellectual property rights of others, harass or abuse other users, or attempt to gain unauthorised access to any part of the Service.
Paid subscription plans are billed monthly or annually as selected at the time of purchase. All fees are quoted in GBP and are exclusive of VAT where applicable. You may upgrade or downgrade your plan at any time; changes take effect at the start of the next billing cycle. We reserve the right to change pricing with 30 days' written notice.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide pro-rata refunds for unused portions of a billing period. If you cancel, your data will be retained for 90 days before permanent deletion, during which time you may reactivate your account.
You retain full ownership of all data you upload to the Service, including member records, media files, and documents. We claim no intellectual property rights over your content. We process your data solely to provide the Service, as described in our Privacy Policy.
We aim to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable notice. We are not liable for any loss or damage arising from service interruptions, whether planned or unplanned.
To the fullest extent permitted by law, PULSE shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
We may suspend or terminate your account if you breach these Terms or engage in activity that is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations and dispute resolution) will remain in effect.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
